[{"id":960,"date":"2024-09-09T14:20:36","date_gmt":"2024-09-09T14:20:36","guid":{"rendered":"https:\/\/sites.allegheny.edu\/title-ix\/?page_id=960"},"modified":"2025-10-02T13:31:23","modified_gmt":"2025-10-02T13:31:23","slug":"sexual-assault-guide","status":"publish","type":"page","link":"https:\/\/sites.allegheny.edu\/title-ix\/sexual-assault-guide\/","title":{"rendered":"Sexual Assault Guide (VAWA)"},"content":{"rendered":"<p><strong>Resources and Information for the Allegheny Community.<br \/>\n<\/strong><strong>What To Do, Where to Report, How to Find Support<\/strong><\/p>\n<h3>Sexual Assault and Consent<\/h3>\n<p>Sexual Violence is any form of sexual assault, sexual exploitation, or dating or domestic violence. Stalking can also be a form of sexual violence.<\/p>\n<p>Sexual Assault is any sexual contact, including but not limited to intercourse (rape), that occurs without consent and\/or through coercion.<\/p>\n<p>Consent is defined as clear, unambiguous, and voluntary agreement between the participants to engage in specific sexual activity. Consent cannot be inferred in the absence of a \u201cno.\u201d A clear verbal or nonverbal \u201cyes\u201d is necessary.<\/p>\n<ul>\n<li>Consent must be clear and unambiguous for each participant throughout any sexual encounter. Talking with sexual partners about desires and limits may seem awkward, but serves as the basis for positive sexual experiences.<\/li>\n<li>Consent cannot be obtained from someone who is asleep or otherwise mentally or physically incapacitated, whether due to alcohol, drugs, or some other condition.<\/li>\n<li>Consent to some sexual acts does not imply consent to others, nor does past consent to a given act imply ongoing or future consent.<\/li>\n<li>Consent can be revoked at any time.<\/li>\n<\/ul>\n<p>Sexual violence or assault can happen to men, women and gender non-conforming persons, and any of these gender identities can be assailants.<\/p>\n<h3>What To Do?<\/h3>\n<p>Here are steps to take after you or someone you know has been assaulted. These are focused on safety in the moments immediately after an assault:<\/p>\n<ul>\n<li>Get to a safe place.<\/li>\n<li>Find an RA or Residential Life staff member to assist you.<\/li>\n<li>Contact Public Safety x3357, who will in turn contact the Meadville Police. Remember, reporting does not mean you have to press charges!<\/li>\n<li>Seek medical attention.<\/li>\n<\/ul>\n<p>If the sexual misconduct you experienced involved any type of physical contact, please consider these steps:<\/p>\n<ul>\n<li>If possible, do not bathe, shower or change your clothes.<\/li>\n<li>Seek medical care as soon as possible.<\/li>\n<li>Take a moment and write down any details of the incident you remember, even if you haven\u2019t decided if you wish to press charges or make a complaint.<\/li>\n<\/ul>\n<p>You may wish to connect with the various support and advocacy services.<\/p>\n<h3>Policy Violation Complaint Process<\/h3>\n<p>Confidential Reporting means that you can talk with someone and they are not required by law to report any assault that may have already occurred. These include clergy, physicians and licensed counselors available at the following locations:<\/p>\n<ul>\n<li>Edinboro Counseling and Psychological Services, 814-734-3975 or 814-332-2782<\/li>\n<li>Meadville Medical Center, located at the Winslow Health and Wellbeing Center, 814-332-4355<\/li>\n<li>Meadville Crisis Line, 814-724-2732<\/li>\n<\/ul>\n<p>Non-Confidential Reporting means that you will talk with someone who is required to report that an assault may have taken place. This does not mean you need to file a complaint through the College, but the Title IX Coordinator for Allegheny will ask to meet with you and discuss your reporting options.<\/p>\n<ul>\n<li>Title IX Coordinator and Deputies<\/li>\n<li>Office of Public Safety, 814-332-3357, who will in turn contact the Meadville Police<\/li>\n<li>Meadville City Police, 814-724-6100<\/li>\n<\/ul>\n<p>You can report to any faculty or staff member that you are comfortable talking to about the incident; however, that person will be required to make a report to the Title IX Coordinator.<\/p>\n<ul>\n<li>An investigator is assigned as investigator to take the complaint and speak with all parties, including any witnesses named by either the complainant or respondent<\/li>\n<li>Both the complainant and respondent are allowed to have an advisor\/support person of choice move through the process with them<\/li>\n<li>Upon conclusion of the investigation, the Hearing Panel will make an administrative determination as to whether the College\u2019s sexual harassment policy has been violated and what the sanction will be for any such violation. Both parties have the right to an appeal, under policy.<\/li>\n<\/ul>\n<h3>Possible sanctions for violations of the sexual harassment policy include<\/h3>\n<ul>\n<li>Warning<\/li>\n<li>Probation<\/li>\n<li>Suspension<\/li>\n<li>Expulsion<\/li>\n<\/ul>\n<p>*In some cases of reported sexual harassment, the College may need to pursue an investigation of policy violation, even if a complainant does not wish to file a complaint.<\/p>\n<h3>Harassment, Discrimination and Sexual Misconduct Policy<\/h3>\n<p>No member of our College community should be subject to harassment, discrimination, or violence based on the individual\u2019s race, color, national origin, ethnicity, sex, sexual orientation, gender, gender identity, gender expression, age, religion, or disability.<\/p>\n<p>Set forth the processes available for reporting, investigating, and resolving allegations of discrimination, discriminatory harassment and sex-based harassment, sexual violence, intimate partner violence and stalking. You have the right to an Advisor of your choice, which can include an attorney.<\/p>\n<p><strong>Will my parents\/guardians find out about this incident?<\/strong><br \/>\nIt depends. If you are a minor, members of the Title IX team have certain mandatory reporting obligations, which may include notifying your parents\/guardians of the incident. If you are not a minor, this incident is a part of your education record, which is protected under the Family Educational Rights and Privacy Act (FERPA). This means that your education record cannot be shared with anyone with whom you have not given Allegheny College permission to share.<\/p>\n<p><strong>Do I have to resolve this through a formal grievance process?<\/strong><br \/>\nNo. One option is to initiate a formal grievance process. Other options are:<\/p>\n<ul>\n<li>Resolve the matter informally &#8211; If you are a Complainant and wish to resolve informally, you must first make a formal complaint. Upon receipt of this formal complaint, the Title IX Coordinator will provide you with additional information. Any party who wishes to resolve the matter informally should contact the <a href=\"https:\/\/sites.allegheny.edu\/title-ix\/title-ix-deputies\/\">Title IX Coordinator<\/a>. All parties must agree, in writing, to informally resolve for this to be an option; and\/or;<\/li>\n<li>Initiate a criminal proceeding &#8211; and\/or;<\/li>\n<li>Initiate a civil proceeding<\/li>\n<\/ul>\n<p>You may pursue whatever option or combination of options that is best for you.<\/p>\n<p>If you wish to have an incident investigated and resolved by Allegheny, students and employees should contact the <a href=\"https:\/\/sites.allegheny.edu\/title-ix\/title-ix-deputies\/\">Title IX Coordinator<\/a> and procedures will be explained.<\/p>\n<p>Those who wish incidents to be handled criminally should contact the local police where the assault occurred. A campus official is available to accompany students in making such reports if desired. Contact the <a href=\"https:\/\/sites.allegheny.edu\/title-ix\/title-ix-deputies\/\">Title IX Coordinator<\/a> or <a href=\"https:\/\/sites.allegheny.edu\/publicsafety\/\">Office of Public Safety<\/a> for more information.<\/p>\n<p><strong>Is there a time limit on when I can report?<\/strong><br \/>\nThere is no statute of limitations on when a complaint can be filed, however there are certain jurisdictional requirements that must be met to pursue a formal grievance process under Title IX.<\/p>\n<p><strong>Will I get in more trouble if I was drinking underage during the incident?<\/strong><br \/>\nThe College maintains a <a href=\"https:\/\/catalog.allegheny.edu\/index.php?catoid=57\">Good Samaritan Policy<\/a> of offering parties and witnesses amnesty from minor policy violations such as underage consumption of alcohol or the use of illicit drugs related to the incident.<\/p>\n<p><strong>What happens if the Respondent fails to comply with the sanctions?<\/strong><br \/>\nRespondents are expected to comply with the assigned sanctions, responsive actions, and\/or corrective actions within the timeframe specified by the final Community Standards Board. Failure to abide by the sanction(s)\/action(s) imposed by the date specified, whether by refusal, neglect, or any other reason, may result in additional sanction(s)\/action(s), including suspension, expulsion, and\/or termination.<\/p>\n<p><strong>What happens if the Respondent transfers, withdraws, or resigns prior to the conclusion of the formal resolution process?<\/strong><br \/>\nIf a Respondent permanently withdraws or resigns, the resolution process may end with a dismissal, as the College no longer has disciplinary jurisdiction over the withdrawn student or former employee. However, the College will continue to address and remedy any systemic issues or concerns that may have contributed to the alleged violation(s), and any ongoing effects of the alleged harassment, discrimination, and\/or retaliation.<\/p>\n<p><strong>What if law enforcement is involved?<\/strong><br \/>\nCollege action(s) or processes are not typically altered or precluded on the grounds that civil or criminal charges involving the underlying incident(s) have been filed or that criminal charges have been dismissed or reduced. The College may undertake a short delay in its investigation if circumstances require. Overlooked populations \u2013 refugees, immigrants, girls, and others \u2013 are most at risk of being enslaved, spending their lives being exploited for the profit of others. This law requires that all colleges and universities (both public and private) participating in federal student aid programs afford sexual assault victims certain basic rights. Schools found to have violated this law can be fined up to $35,000 or lose their eligibility to participate in federal student aid programs. Many of the\u00a0guidelines for\u00a0<a href=\"https:\/\/sites.allegheny.edu\/title-ix\/supporting-a-complainant\/\">Supporting a Complainant<\/a>\u00a0who has been sexually assaulted can also apply to supporting someone who has been accused of assault, but here are some additional guidelines for significant others\u00a0of someone who has been accused:<\/p>\n<ul>\n<li>Be available to listen if they\u00a0decide that they want to discuss the accusations, and try to provide an atmosphere that is conducive to open and honest discussion.<\/li>\n<li>Recognize that there is a difference between showing support for and showing support for\u00a0their actions. You can accept and love them\u00a0as a person even if you don\u2019t agree with their behavior.<\/li>\n<li>Avoid making any judgments or placing any blame on\u00a0them or their\u00a0accuser \u2014 if you weren\u2019t there, you can\u2019t say for sure what happened.<\/li>\n<\/ul>\n<p>Whether they are\u00a0the complainant or respondent you can contact the Title IX Coordinator\u00a0for more information about resources for you and them, but first be sure that they are\u00a0comfortable with that.
